Terms & Conditions
It is important that you read and understand the terms and conditions contained in this agreement before you register for the auction. By acknowledging this Buyer’s Agreement (“BA”) between the Buyer and Timeless Art (“the Company”), the Buyer agrees to the following terms and conditions:
Any unauthorized use of the website material may violate copyright, trademark, and other laws. You should not sell, copy or modify the website displayed works and use the material in any way for any public or commercial purpose. The use of the material or any portion thereof on any other website, or in any publication, database, catalogue or compilation, or in a networked computer environment for any purpose other than personal browsing of the Web Site without the prior written permission of the Company is strictly prohibited. Any sharing or copying of the website contents will require you to email us at contact@timelessart.com
Reserve Price
Reserve price is the confidential minimum price the auctioneer will accept. The auctioneer reserves the right to reject a sale if the Reserve Price is not met.
Auction Viewing
Auction catalogs will be open for viewing 2 weeks before the commencement date. Viewing is open to the public and can also be done online before the closing date of the auction. Buyers are required to register and arrange for viewing appointments by contacting us.
Bidding
The Auction will be held online at (“the Auction”). The Buyer agrees to the terms and registers to participate at the Auction. Hammer Price is the highest bid accepted by the Auctioneer. The Buyer agrees to buy the Lot at the Hammer Price if the Buyer’s bid is the highest bid accepted by the Auctioneer (“Successful Bid”).
The Buyer agrees that after the successful bid, the Company will not be liable for any loss, theft or damages to the Lot during the period that the Lot is in the Company’s possession. The Buyer takes responsibility to collect and bear the delivery and packing costs of their lot(s) upon successful bid.
Conditions of Sale
The Buyer agrees that the Lots are sold as it is in the pictures provided and otherwise in the condition they are in at the time of the Sale. Lots sold vary greatly in terms of age, authenticity, category and condition. Therefore, we recommend that the Buyer seeks advice from Buyer’s own professional advisors/appraisers before putting in the bid. The Buyer agrees that all Lots are sold as it is and all Sales are final and non-refundable.
Payment and Buyer’s Commission
In the event of a successful bid, the Buyer agrees to pay the Company:
(a) the Hammer Price; and
(b) the Buyer’s Commission which is at 20% of the Hammer Price.
The Buyer agrees to make full payment, consisting of the Hammer Price and Buyer’s Commission, and collect all Lots won at the auction within ten (10) days after the sale date. Invoices will be sent to the Buyer’s email address upon successful bid of the sold Lots. A warehousing fee of S$25.00 per day will be charged to the Buyer should the Buyer fail to collect the Lots by the stipulated period within 10 days after the auction date. The Buyer will not acquire title to the Lot until all amounts due to the Company from the Buyer have been received by the Company in full.
For sold Lots that are not collected by the Buyer after the sale date, the Company will not be liable for any loss, theft or damage to the Lot. Uncollected lots will incur storage fees, and if not collected within 3 months, we reserve the right to dispose of or resell the items to recover any storage, disposal, and administrative fees incurred.
The Buyer agrees to make payment for the Lots via cash, or bank transfer (in Singapore Dollars) or through Stripe, an online credit card payment system (with 2% commission fee). The Buyer agrees to provide his credit card details for the purpose of making payment in relation to Lots won at the auction. Payment by credit cards will be subjected to an administration fee of at least 2.0%.
All marketing merchandise such as brochures, pamphlets, displays, and etc. will be the property of the Company, unless otherwise mutually agreed upon by both the Buyer and the Company.
Remedies for Non-Payment
Should the Buyer fail to make full payment in good cleared funds for the Lot after the Auction, the Company shall have the right to exercise its legal rights and remedies, and these include but not limited to the following:
(a) Cancel the sale;
(b) Resell the Lot publicly or privately and on such terms as the Company deems fit;
(c) If the Company resells the Lot as stated in (b), the defaulting Buyer shall be liable for payment of any deficiency between the total amount originally due to the Company and the price obtained upon resale, as well as for all reasonable costs expenses, damages, legal fees, premiums and commissions of whatever kind associated with both sales or otherwise arising from the default
(d) To take such other actions as the Company deem necessary or appropriate.
Law and Jurisdiction
The rights and obligations of the parties with respect to these conditions of sale, the conduct of the auction and any matters connected with any of the foregoing shall be governed and interpreted by the laws of Singapore. By bidding in the Auction, the Buyer shall be deemed to have submitted, for the benefit of the Company to the exclusive jurisdiction of the Courts of the Republic of Singapore.
